Burton dau of Robert Burton. Robert served on the Sussex County Grand Jury on 1
November 1709.222 Robert owned land on Swan Creek in
Indian River Hundred, Sussex County, Delaware.223 On 20
August 1717, he had 136 acres of land surveyed on Swan Creek, and on 27 February
1717/8, he had another 97 acres of land surveyed on Swan Creek.224
Robert made his will on 13 July 1720/21 and it was probated on 1 August 1721.225
In his will, he mentions his wife, Sarah Prettyman; son, William Prettyman;
daughters, Sarah, Catherine, and Ann Prettyman; son-in-law Robert Lassey; and
daughter-in-law Elizabeth.225 In this time period the
common term for stepchildren was in-law. I therefore believe the son and
daughter-in-law were the children of his wife, Sarah, by her marriage to John
Lacey. John Lacey died before 1721. On 13 May 1728, Robert Lacey received his
share of the estate of his father, John Lacey, from his mother, Sarah Prettyman.226
On 25 Feb 1729,
Elizabeth Lacey received her share of the estate of her father, John Lacey,
from her mother, Sarah Prettyman.226 I believe the Robert
Lassey named above was the Robert Lacey who deeded land to William Prettyman,
Jr, son of Robert Prettyman, on 5 November 1729.227 Robert
Burton in his will, made 16 September 1724 and probated on 16 October 1725,
mentions his daughter, Sarah, and his grand child Robert Prettyman, son of
Robert Prettyman.228 Robert Prettyman in his will did not
mention a son Robert, and we assume that Robert was born after the death of his
father. Sarah Burton Prettyman married third by 1731 Anderson Parker.229

this William the title William III. William purchased 50 acres of land on the
east side of Swan Creek on 5 November 1729 from Robert Lacey.227
On 18 September 1739, John Hood, son of Adam Hood, was bound out to William
Prettyman and his wife, Sarah.231 William, on 2 August
1757, sold land on Swan Creek to John Williams.232 The
land was the 97 acres granted to his father, Robert, on 13 September 1718.
William III has been an enigma to Prettyman researcher’s for many years. This
is because William III has been confused with William Prettyman, whose will was
probated in 1772. William III in his will, made on 5 April 1757 and probated on
13 September 1766, gives us an important clue as to his father. The clue is that
one of the executors he named was his brother, Robert. By eliminating the other
Robert’s we get a good idea of who was the father of William III. It appears
that Robert, son of Thomas Prettyman, P35, was dead by 1725 as his grandfather,
Robert Burton does not mention him in his will.228 Also
Elizabeth Coulter, daughter of Thomas, petitioned the court in 1763 to sell land
of her brother, Robert, who died as minor.233 We can also
rule out William son of William Prettyman II, P32, because he died by 1739 as
his father, William, was in court as administrator of his estate. Also Robert,
P77, could not be the father of William III as Robert's son, William, died
intestate and without children per Sussex deeds. Also Robert, son of William
Prettyman died 1772 (P412) could not be the brother of William III because this
Robert could not have been born until or after 1751. Robert’s, P338, mother,
Elizabeth, did not marry William Prettyman, P412, until or after 1751 after as
Woolsey Burton, first husband of Elizabeth, will was made in 1751 and probated
on 8 May 1751 this date.236 I do not think a man would
have named a six-year-old as one of the executors of his estate. On 17 Apr 1780,
a Robert Prettyman and Margaret Houston obtained an estate administration bond
for William Prettyman of Indian River Hundred, marriner. This is most likely
William, P412.237 Also, we have no indication of the death
of Robert Prettyman, P411, until 1792238, and we know he
was alive on 18 Aug 1771 as he was in court on his brother, William’s estate.239
See also discussion of Robert Prettyman, P411. Also, Robert, P411, was appointed
guardian in 1766 by the court of William III’s daughter, Magdelin Prettyman,
under age of 14 years.240 This is also indication that the
other children of William III were of legal age as there is no indication in
Orphans Court records of a guardian being appointed for them. By the process of
elimination, the only Robert available to be the brother of William III is
Robert Prettyman who married Eleanor Craig. When you plot out the land that
children of this Robert inherited, it is land his mother, Sarah, inherited from
her father, Robert Burton. It was probably William III that received a 220 acre
land grant on Swan Creek in 1748 called "Grubby".241
William III in his will named his wife, Sarah; son, Burton Prettyman and
daughters, Sarah Prettyman, Magdalene Prettyman, Naomi Boyce and Margaret
Houston. William III, in his will, gave to his son, Burton, the plantation I now
live.242 Two times in the will William III stated;
"all the remainer of my moveable Estate to be Equally divided amongst all
my Children above mentioned." It appears from this language that William
III had a child or children that were not mentioned in the will. If he had no
other children, why did he use this language? It is obvious to me that the
William (P412) had alredy been provided for by William III, and William III did
not need to provide for him. William III appointed his wife, Sarah, and brother,
Robert Prettyman, his executors. Children:242

Burton Prettyman married first Woolsey Burton.236 Woolsey
died in 1751 as his will was made and probated in 1751.245
Herndon244 has Elizabeth’s daughter, Elizabeth, marrying
William Prettyman. The wills of Woolsey Burton, Frances Bagwell Burton, and
Elizabeth Burton Prettyman show that Elizabeth in fact married second William
Prettyman.246 This is also supported by Sussex County,
Delaware deeds and Orphans Court records.247 In his will
Woolsey Burton names his wife, Elizabeth; sons, William and Woolsey Burton;
daughter, Elizabeth Burton and an unnamed child.245
Frances Bagwell in her will, made 25 February 1750 and probated in Worcester
County, Maryland on 3 July 1751, names John Stratton Burton, Elizabeth Burton,
William Burton, and Ann Burton, as children of daughter Elizabeth Burton.248
Elizabeth Prettyman made her will, 4 February 1777, and it was probated 4 April
1777.249 In her will, she states my eldest son John
Stratton Burton, second son William Burton, dafter [daughter] Ann Bagwell and my
youngest son Robert Prettyman. To Robert she gave land at Warwick that she owned
in her own right, and two negroes Moses and Saul. It was her will and desire
that "my excr [executor] should pay unto my son Robert when he arrives to
the age of 21 years". From her will, it is obvious that Robert was not 21
years old in 1777 and therefore would have been born after 1756. Elizabeth’s
son, Woolsey Burton, died before 2 April 1772, her daughter, Elizabeth Burton,
may have died before her mother as she is not mentioned in the will. On 2 April
1772, Elizabeth Prettyman, John Stratton Burton, William Burton, Joyner, and
William Bagwell and wife Ann, sold 91 acres of land in Sussex County that
William Burton of Worcester County had devised to his grandson, Woolsey Burton
deceased.250 William Prettyman made his will on 20 July
1766 and it was probated 3 January 1772. In his will William named his wife,
Elizabeth; sons, Burton and Robert and daughter, Magdalene Prettyman.251
Elizabeth did not mention Burton and Magdalene Prettyman in her will and they
must have died prior to their mother. Children:

Leah Cannon. Burton died intestate. The estate administration began in 1789 and
ended in Mar 1802. The first administrators were Leah Prettyman and Elijah
Cannon, Jr. Other administrators of the estate were Joseph Waples and Benjamin
Prettyman. On 24 Feb 1792, William Dashiel Prettyman petitioned the court to
divide the Indian River Hundred lands of Burton Prettyman, deceased. Burton had
left a widow and ten children. On 30 apr 1800, a petition was filed in the
Orphan’s Court for division of one-third of the lands of Burton Prettyman.
Joseph Robinson, guardian of Elizabeth and Dashields R. Prettyman, minor
children of William D. Prettyman, eldest son of Burton Prettyman deceased, filed
the petition. It was stated that Leah Waples, late Leah Prettyman, widow of
Burton Prettyman had one-third of Burton’s lands as her dower and that she was
now deceased. Ribinson wanted William D. Prettyman’s two children to receive

Richards. On 19 Nov 1800, when Joseph Robinson was appointed guardian for
Elizabeth and Dashieds Prettyman, they were both under fourteen years of age.
Dashields first appeared in 1815 on the Sussex County tax lists for indian River
Hudred, and was referred to as Robinson D. In 1818, he was referred to as
Dashiell R; In 1820, It was Deshields R; 1822-1827, his name was Robinson D; and
in 1829 and thereafter, his name was referred to as Dashields R. In 1835,
Dashields moved into Dagsboro Hundred. He owned land in both Dagsboro and Indian
River Hundreds at different times between 1835 and 1850. On 22 Aug 1843,
Dashields R. Prettyman of Indian River Hundred sold 143 acres of land in the
same hundred to James Causey of Maryland. Dashields had purchased this land from
Eli Carey. On 22 March, Dashields deeded 144 plus acres of land in Indian River
Hundred to Thomas Robinson. This land was adjacent to Perry Pool and others. On
1 June 1848, Dashields deeded 293 plus acres of land to Thomas R. and Joseph R.
Prettyman for $1.00 and the natural love and affection he held for them. All of
the parties were from Dagsboro Hundred. The land was adjacent to that owned by
Zeporah Morris, Joseph and John Marvel and William Morris. Children:253

Cannon and wife, Sally, deeded 99 acres of land in Indian River Hundred to
Joseph Waples (Cannon’s step-father). This was land that had been laid off for
Leah Prettyman as the dower lands of her first husband, Burton Prettyman. Cannon
died intestae, and Peggy Prettyman, Cannon’s widow, administered the estate.
William Prettyman was surety. Peter and Burton Prettyman were among those paid

Prettyman, was the guardian of Harriett after Cannon’s death. Burton made
accountings of the estate in 1819, 1820, and 1824. In 1824, the estate showed
income from farm land rented out in years 1822-1824. Harriett was buried on 9
Oct 1826. Her portion of her father’s estate was rolled into the guardian
accounts of her brother, Joseph Prettyman, and sister, Louisa Prettyman.

May 1828 Sussex Co., DE. Cannon’s brother, Burton Prettyman, was the
guardian of Louisa after Cannon’s death. On 7 June 1820, Burton was paid for
raising her a year. In 1822, the account shows that Louisa was
"insane". In 1825, Burton was paid for raising her for 3 years, 3
years, she "having fits and being insane". On 27 May 1828, Burton
was paid for 2 years, 7 months, again noting that Louisa was insane.

1821, Cannon’s brother, Burton, was the guardian of Joseph. In the years
1823-1829, his step-mother, Peggy Prettyman, was Joseph’s guardian. On 26
Oct 1830, Joseph acknowledged to the Orphan’s Court that Burton Prettyman
had paid him money he was due. On 16 Oct 1840, Joseph Prettyman of Indian
River Hundred made a deed to Burton Prettyman, son of Burton, also of the same
hundred, for 100 plus acres of land in Dagsboro Hundred. This land was
adjacent to that owned by Phillip Wingate, C. S. Williams, D. Waples and John
Willey. It had belonged to Joseph’s mother, Sally Prettyman, and wife of
Cannon Prettyman, both deceased. After moving to Schuyler County Illinois,
Joseph gave William B. Ewing his power of attorney in Sussex County, DE, to
collect money from Burton Prettyman of Sussex that is due to Joseph.

Burton’s guardian through early 1804. On 11 July 1804, Burton was paid
interest on his guardian account from 22 May 1790. He also received his share of
the intestate lands of his sister, Sally Barker. It was also noted that he had
been educated. On 15 Feb 1804, Burton 18 years of age, minor son of Burton
Prettyman, late of Indian River Hundred, chose Cannon Prettyman as his guardian.
On 16 July 1809, an exhibit to the Orphan’s Court by Cannon Prettyman mentions
that Burton was due interest from 21 July 1802 to 16 July 1809. Burton was to
also receive his share of the land that had been laid off to the widow of Burton
Prettyman, Sr. Joseph Waples was paid cash out of the account on 20 Oct 1804. On
17 July 1810, Burton Prettyman, youngest brother of Sally Barker, was in Court
and willing to accept her 100 acres of land at 200 pounds. He agreed to pay the
other heirs their interest in the land. On 13 Sep 1811 Burton, son of Burton,
and his wife, Lydia, sold 100 acres of land in Indian River Hundred to Phillip
Marrinor. This land had belonged to Zadock Barker, in right of his wife, Sally.
It then came into the possession of Jehu Barker and wife, Polly, late Polly
Prettyman. Jehu conveyed to this Burton on 11 Nov 1807. On 15 June 1851, Burton,
son of Burton, and wife, Ann (signed her name as Nancy), of Indian River
Hundred, sold land in Dagsboro Hundred to Gardner H. Wright. This was the same
land Burton had purchased from his nephew, Joseph, in 1840. On 25 Aug 1846,
Burton deeded 77 ½ acres in Indian River Hundred to Burton C. Prettyman [his
son]. This was part of an old tract known as "Broad Water". Burton, sr,
died 20 Jan 1848, about 70 years of age {born about 1778} according to the
obituary record. A tombstone record shows a birth year of 1785. On 24 Dec 1851,
Nancy Prettyman, of Indian River Hundred, sold 12 plus acres of land to John B.
Burton. This land had been assigned to Burton Prettyman and wife, Nancy, for the
division of lands that had belonged to Levi Hill. Nancy, of Indian River
Hundred, made her will on 27 July 1855, and it was probated on 15 Sep 1863. She
named sisters, Charlotty and Sarah Burton. She left six acres of land to John
Prettyman. She left another parcel of land to Alfred to Alfred B. Prettyman, son

Craig.258 On 16 December 1731, Anderson Parker and wife,
Sarah Parker, widow of Robert Prettyman, for love and affection towards Robert
Prettyman, son of my wife Sarah, deeded to Robert 300 acres of land.259
This 300 acres was the northern part of the 1100 acre tract of land that had
belonged to Robert Burton, father of Sarah. John Futcher on 4 May 1769 sold land
known as "Strife" to Robert Prettyman.260 This
was the land John Futcher had inherited from his uncle, Thomas Prettyman,
Esquire. "Strife" was granted in 1715/16 to John Prettyman, Esquire
#P31, father of Thomas Prettyman, Esquire. "Strife" was located along
the western boundary of the 300 acres that Robert owned of the 1100 acre tract
of Robert Burton. A deed from Constant Marriner to Robert Marriner on 1 May 1780
shows that Robert Prettyman still owned the 300 acres of the 1100 acre tract.261
Robert died intestate, but the Orphans Court records give a good indication of
his children. On 20 January 1792, William Coleman petitioned the Orphans Court
for division of Robert’s lands.262 The records show that
Robert died and left widow, Eleanor, and had three children, William Prettyman,
Sarah, wife of David Shankland and Nelly, wife of William Coleman. Sarah
Shankland, in her will in 1819, also mentions her brother, Robert, and his son
Jeames [James]; and her brother, William and his son, Robert.263
When land that Sarah Shankland inherited from her father is plotted out, it is
the area of "Strife" that Robert purchased from John Futcher and part
of the 300 acres of the 1100 acre tract of Robert Burton. We also platted out
the land of William Prettyman, P473, it matches up on the West side with the
East side of Sarah Shankland tract, and there is an exact match, and therefore
shows that this Robert is the son of Sarah Burton Prettyman. Children:264

Harmonson , and married second Luke Burton. William died intestate, and his
widow, Elizabeth, was the administrator of the estate. On 7 Feb 1791, she and
George Walton obtained an estate administration bond. A large inventory was
taken by a Woodman Stockley and a Robert Burton. William had about 200 acres of
land at his death in Indian River Hundred with a log house, adjacent to John
Lingo, Cord Burton, and others. On 18 July 1821, Robert petitioned the Court to
divide the dower lands from his father, William’s estate, between him and
James Burton, in right of his wife, Robert’s sister, Mary. It was mentioned
that they had a brother, Hamilton, who had died before the dower lands had been

unnamed heirs. Mary, wife of William, died intestate. On 11 Mar 1862, her
grandson, John H. Prettyman, obtained an administration bond for her estate.
James Prettyman was on the list of sales made of her personal property at
